Sailors famously have “salty” outbursts, and it is common for SailGP commentators to apologize for cuss words that get picked up microphones. Who are we kidding? No live sport fully mic’d is immune. The broadcast should just start with a disclaimer – Warning: This show may contain strong language – and be done with it.

But an incident during the 37th America’s Cup provoked a listener to file a complaint with the Arbitration Panel, claiming that misconduct had occurred in contravention of Rule 69 of the event’s racing rules.

The Arbitration Panel found that it was after an onboard interview when an annoyed British skipper Ben Ainslie was heard calling the questioner a ‘f**king w**ker”. They also discovered that in the same race, as New Zealand crossed the finish line, Kiwi skipper Peter Burling said, “F**k we crossed swords there didn’t we.”

The Arbitration Panel findings did not consider either incident to break the rules of the event, did not
cause widespread offense, and has not brought the sport into disrepute, but did remind competitors that what they say on board may be heard on the broadcast. Copy!

A similar incident and outcome occurred during the 2017-18 Volvo Ocean Race when an onboard video prompted a viewer to file a Rule 69 misconduct complaint, with the International Jury deciding that the incident “did not commit misconduct because the video has not caused widespread offense worldwide and has not brought the sport into disrepute.”

Following the publication of the AC37 Protocol and AC75 Class Rule on November 17, 2021, the AC75 Class Rule and AC Technical Regulations were finalized on March 17, 2022. The entry period was from December 1, 2021 until July 31, 2022, but late entries for the 37th America’s Cup could be accepted until May 31, 2023. The Defender was to announce the Match Venue on September 17, 2021 but postponed the reveal, finally confirming Barcelona on March 30, 2022. The 37th America’s Cup begins October 12, 2024.
